This privacy notice tells you what Just Minded will do with your Personally Identifiable Information (“PII”) from initial point of contact through to after your counselling has ended, including: Why Just Minded can process (i.e., use) your PII and for what purposes. Whether you have to provide PII to Just Minded. How long Just Minded stores PII for. Whether your PII can be shared with other recipients. Whether Just Minded intends to transfer PII to another country. Whether Just Minded undertakes automated decision-making or profiling. Your data protection rights. Just Minded is a registered ‘Data controller’ which is the term used to describe the organisation that collects and stores and has responsibility for PII. Just Minded is registered with the Information Commissioner’s Office. Just Minded Ltd. is a limited registered company (Reg. Co. No. 13584611): Just Minded’s phone number is: 07442-868274; Email address is: firstname.lastname@example.orgJust Minded’s Lawful Basis for Holding and Processing PII
GDPR states that Just Minded must have a lawful basis for processing PII, which are different depending on the stage at which I am processing your data. These are explained below: If you have had therapy with me and it has now ended, I will use “legitimate interest” as my lawful basis for holding and using your personal information. If you are currently having therapy or if you are in contact with me to consider therapy, I will process your personal data where it is necessary for the performance of our contract. GDPR also makes sure that I look after any sensitive personal information that you may disclose to me appropriately. This type of information is called Special Category Personal Information (“SCPI”). The lawful basis for Just Minded processing any SCPI is that it is for provision of health treatment (in this case, counselling) and necessary for a contract with a health professional (in this case, a counselling contract between you and Just Minded).
When you contact Just Minded with an enquiry about counselling services, Just Minded will collect PII to enable us to satisfy your enquiry. This will include: name; email address; telephone no.; postal address; brief assessment information (from your disclosures); details of safeguarding issues (these will be shared with you). Alternatively, your GP or other health professional may send Just Minded your details when making a referral, or next of kin/trusted individual may supply your details if making an enquiry about services on your behalf. If you decide not to proceed with any Just Minded services, we will ensure all PII is deleted within 14 days. If you would like me to delete this information sooner, please contact us and we will make best endeavour to meet your request ASAP.While you are Accessing Counselling
Everything you discuss with a Just Minded Counsellor is confidential, subject to specific exceptions and exemptions (see ‘Limits to Confidentiality’ doc.). I will always try to speak to you about this first, unless there are safeguarding issues that prevent this. Just Minded will keep a record of your personal details to help the counselling services run smoothly. These details are kept securely: paper copies are held in a locked secure cabinet; electronic copies are held on a Just Minded password-protected laptop. These are not shared with any third-party. Just Minded Counsellors are required to keep electronic written notes of each session as part of good professional practice, which are held on a Just Minded password-protected laptop. Text messages will be retained on a Just Minded PIN-locked mobile for the duration of the counselling, as will emails. After Counselling has Ended
Once counselling has ended your records will be kept for seven years from the end of your contact with Just Minded and are then securely destroyed. If you want Just Minded to delete your PII sooner than this, please discuss this with us – you may be asked to sign a disclaimer as your request will be contrary to practice guidance for healthcare professionals.Third-Party Recipients of PII
Just Minded may need to share some elements of PII with third-parties who are contracted (e.g., a clinical Supervisor). In such cases, Just Minded will take great care to ensure that any contract with the third-party states what they are allowed to do with PII shared with them and ensure your PII is not used in any way other than the task for which they have been contracted. NB, clinical notes are never shared with third-parties, except in cases of safeguarding or an order from a Court.
